1. Definitions
- “Service” means the Fleet Plus web application and related marketing website.
- “Customer” / “you” means the business or individual that registers for and uses the Service.
- “User Content” means data you or your authorised users upload or enter (vehicles, drivers, challans, documents, notes, and similar records).
2. Eligibility and account
You represent that you are at least 18 years of age and have authority to bind the business entity on whose behalf you use the Service. You must provide accurate registration details, keep credentials confidential, and promptly disable access for users who leave your organisation. You are responsible for all activity under your account.
3. The Service
Fleet Plus provides software tools to help manage fleet operations such as vehicles, drivers, trips, challans, maintenance, and related ledgers. Features may evolve over time. We may add, modify, or discontinue features with reasonable notice where practicable. The Service is provided as a business software tool and does not itself constitute licensed transport, logistics, legal, tax, or accounting advice.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose under Indian law, including fraud or unauthorised access.
- Upload malware, scrape the Service in an abusive manner, or attempt to bypass security or role controls.
- Infringe intellectual property or privacy rights of others when uploading User Content.
- Resell, sublicense, or provide the Service to third parties except as expressly permitted in writing.
- Use the Service in a way that interferes with other customers or our infrastructure.
5. Customer responsibilities (India operations)
You remain solely responsible for the accuracy of operational records you enter, for compliance with motor vehicle, labour, GST, and other Indian regulatory requirements applicable to your transport business, and for obtaining any consents or notices required to process personal data of drivers and staff you onboard into Fleet Plus. Software records do not replace mandatory government filings, physical documents, or statutory registers where those are still required.
6. Fees and payments
Paid plans, if offered, are described on our Payments page or in a separate order form. Fees are payable as stated for your plan. Applicable GST or other Indian indirect taxes may be charged where required. Unless stated otherwise, fees are non-refundable except as required by Indian consumer protection law or as we expressly agree in writing. We may suspend access for prolonged non-payment after notice.
7. Intellectual property
Fleet Plus and its software, branding, and documentation remain our intellectual property (or that of our licensors). Subject to these Terms and timely payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business operations in India during your subscription. You retain rights in your User Content; you grant us a licence to host, process, and display User Content solely to provide and improve the Service.
8. Privacy
Our handling of personal data is described in the Privacy Policy , which forms part of these Terms by reference.
9. Confidentiality
Each party agrees to keep the other’s non-public business information confidential and use it only as needed to perform under these Terms, except where disclosure is required by Indian law or a competent authority, or the information is already public through no breach of this clause.
10. Disclaimers
To the maximum extent permitted by Indian law, the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet every operational or compliance outcome for your fleet. You should maintain independent backups of critical business records.
11. Limitation of liability
To the maximum extent permitted by Indian law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from the Service. Our aggregate liability arising out of or relating to the Service in any twelve-month period shall not exceed the fees you paid to us for the Service in that period (or INR 5,000 if you are on a free plan), except where liability cannot be limited under applicable Indian law (including for fraud, wilful misconduct, or death/personal injury caused by negligence where such carve-outs apply).
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and reasonable legal costs arising from your User Content, your misuse of the Service, or your breach of these Terms or applicable Indian law, except to the extent caused by our wilful misconduct.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create a security risk, or fail to pay amounts due, after notice where reasonable. Upon termination, your right to access the Service ends. We may delete or anonymise User Content after a reasonable retention window, subject to legal obligations and our Privacy Policy. Export any records you need before termination where the product provides export features.
14. Force majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, terrorism, riots, epidemic, government action, labour disputes, power or internet failures, or failures of third-party hosting providers, for the duration of the event.
15. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to any mandatory rights you may have, courts at Rourkela / Sundargarh, Odisha, India shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms. Before filing a claim, the parties will attempt in good faith to resolve the dispute through written notice and negotiation for 30 days.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Service after notice of material changes constitutes acceptance, except where Indian law requires your express consent.
